Mark's List and Related Sites Twitter Terms of Service

Following are the Terms of Service regarding the use of Twitter features on Mark's List, Movies and Gossip, Surprising Dining, The Mad Paparazzi and all related Mark's List sites. Violation of the Terms of Service may result in the advertiser, person or other entity being removed from Twitter Timelines and Twitter Banner Ads that are featured on Mark's List.

A word to the wise, while Twitter may at times appear to be the Wild West of communication, Mark's List and our associated web sites are not! We expect that in return for being included in our timelines, you will show consideration and respect for the wide variety of people that use our growing network.

  • Mark's List Twitter usage guidelines are subject to change without prior warning. Since we have no way to anticipate all of the foolish things people will do, we recommend that you check this page frequently to insure that you are using the Twitter features of Mark's List in accordance with our most current policies.
  • Entities in our Twitter Timelines and Twitter Banner Ads are encouraged to make sensible comments about their own services, events and other related current topics. We also encourage you to consider the image of your business and the damage that one misunderstood or offensive Tweet may do to your years of hard work or ours. In addition, we encourage using the timelines to develop an image for your business or your persona. Using applications like TwitPic, TwitWoop and who knows what else will be dreamed up allow you to make the conversation fun, spontaneous and more interesting to your potential clients than traditional media. Simply put, make it fabulous, keep it fabulous and people will think you are fabulous.
  • Advertisers are not charged for Twitter features included on Mark's List for two reasons; 1) Twitter does not charge for their service and reselling a free service is unethical, likely prohibited by Twitter and probably against the law in more than a few places. 2) As evidenced by the outages caused by the hacker attack on Twitter in early August 2009, we have no control over the reliability of Twitter's product. If you are struggling to figure out how we can be claiming our Twitter service is free when you are paying to advertise, think of it this way; Mark's List Twitter services are like buying dinner and getting a free dessert, if you don't buy the dinner, you don't get the free dessert. The dessert was the incentive to buy the dinner and so it is with Twitter on Mark's List. Twitter is an incentive to get you to buy an advertising package, but it is not a part of the package!
  • Our 'Three Strikes Policy:' In general, after the first offensive or otherwise inappropriate Tweet, contributors to our timelines may be notified and removed for a minimum of three days. The second offensive or otherwise inappropriate Tweet may result in notification and a minimum seven day suspension. The third offensive or otherwise inappropriate Tweet may result in permanent removal without notification.
  • Our 'First Strike Policy:' Tweets that a member of Mark's List deem to be severely offensive to an individual, business, ethnic group or any other entity will cause the permanent removal of the business, entity or person from our timelines without warning or notification.
  • Businesses and persons in Mark's List Twitter timelines are solely responsible for the content of their Tweets and the Tweets of anyone with passwords and access to their Twitter accounts. Mark's List assumes no responsibility for defamatory or otherwise libelous statements of Timeline inhabitants or of anyone with access to the followed Twitter accounts.
  • Please remember that using profane, defamatory or other language that may be deemed offensive by any ordinary person, business or entity may result in removal from Timelines and any other services associated with Twitter found on Mark's List.
  • Uploading nude or otherwise offensive images through links to TwitPic, as icons or through any other means may result in removal from Timelines and any other services associated with Twitter found on Mark's List.
  • Including links that forward to illegal activities, illegal services or anything illegal in any way or to links that are found to be otherwise offensive or contain fraudulent content or services may result in removal from Timelines and any other services associated with Twitter found on Mark's List.

  • Mark's List displays a variety of Timelines for differing purposes. Some of the timelines follow Mark's List clients (only) official Twitter accounts. Other persons associated with the businesses are not allowed to contribute from separate Twitter accounts on the business' behalf. Why? In order to maintain the integrity of information about the business and the accountability of people included in the Timeline conversations. One bitter employee, one relationship gone bad, could ruin a business' reputation.
  • Finally just a little general direction about using Twitter. If you want to sell your products to Republicans don't say bad things about Sarah Palin. If you want to sell to Catholics then don' t say bad things about the Pope. If you want to sell to old ladies or children and their parents, friends or aunts and uncles of children or even your mom or my mom or anyone's mom (in other words anybody) then don't be profane, abusive or otherwise offensive in any way. The purpose of Twitter in general and specifically the Timelines and other features on Mark's List are to allow you to creatively improve and build your image, your aura if you will, not to offend, intimidate or degrade others. If making negative comments is your goal, get a separate Twitter account, we won't follow you, but that way you have a place where you can say anything you want. We own over 40 Twitter accounts. You can have as many as you want too!
  • All decisions made by management of Mark's List regarding the inclusion of your business or personal Twitter account in Mark's List Twitter timelines or other features are permanent, irrefutable, uncontestable in courts of law and will not result in the refunding of a portion or all of any fees associated with advertising on Mark's List. Don't even bother trying. It's free remember?
